Copyright Royalty Board v. Podcasters

Has anyone figured out if/how this ruling by the CRB (pdf), which goes into effect on Sunday, impacts podcasters? Skimming the 125 page document, I only see reference to webcasters who are streaming. Nothing about on-demand/downloaded programs.

  1. The best that I can tell is that in both the U.S. and Canada a podcast is safe if the artist has assigned rights to you for the use of their song in your podcast. You do have to ensure however that the artist maintains all rights to their song and hasn’t signed at least some of them over to a record label. This appears to be less of an issue with artists signed to so-called indie labels.
